1. PRODUCT WARRANTY

 1.1 PREMISE

All components of a bicycle (frame, wheels, cranks, handlebars, chain, tires etc.) have a useful life cycle, which depends on many factors such as: the technology and materials used, the weight and power of the cyclist, care and maintenance, how much, how and where they are used, the use of aggressive cleaners, external factors such as strokes, crushing or falls.
The components are subject to normal wear, surface wear, but also to a type of wear called fatigue of the materials, which consists in a progressive separation of the molecular structure that initially appears as an almost invisible micro-fracture and grows with time until to weaken the component to the point that it suddenly yields when the fracture has become large enough. Fatigue is initially barely visible and therefore more insidious; to reduce the risk of suffering an accident, it is necessary to monitor wear and recognize any signs of fatigue before it can cause catastrophic failure.
Any product that is worn or has lost its structural integrity or shows damage or signs of fatigue must be replaced immediately, to reduce the possibility of suffering an accident that could cause serious injury.

 1.2 DESIGNATED USE

TRIS BIKE is conceived and designed for an exclusively urban use. The use of the bicycle in any case involves risks and factors such as poor maintenance, the omission of frequent inspections, poor visibility, darkness or rain can greatly increase these risks. Proper maintenance, frequent inspections, the use of a helmet, high-visibility clothing, lights, rear-view mirrors, horns and prudent driving help to reduce these risks, without eliminating them completely.

Our frames are built to withstand the constant stresses of an urban environment, however an inappropriate use of the bike, and the repeated stresses due to continuous impacts could lead to a deterioration of it. We advise against continuous exposure to bad weather because it could cause malfunctions and frame degradation. Check periodically that there are no problems or cracks in the joints.

We use handlebars that are conceived and designed for a purely urban and non-competitive use. The right maintenance and use of the product will extend its life. Make sure periodically that the handlebar is anchored with the right tension to its attachment, checking the tightness of the fixing screws. Incorrect positioning or fixing could cause the handlebar to become detached from the steering tube or to move incorrectly during use.

Our saddles are conceived and designed for an exclusively urban use. Even if equipped with water-repellent treatments, waterproofing is not guaranteed, and it is therefore advisable not to expose them to bad weather for long periods.

The motors we use are conceived and designed for an exclusively urban and non-competitive use, we advise against the use off road or extreme activities such as jumps, descents on uneven paths or similar. Motors are designed to withstand rain and direct water but are not resistant to high-pressure jets, especially in the bearing area. Similarly, long exposure to the elements is not recommended or guaranteed.

 1.3 WARRANTY

All products, purchased directly from SASP Innovation or from authorized distributors, are covered by a warranty for a period of 24 months from the date of the purchase specified in the invoice. The warranty covers any defects in manufacturing, production or anomalies found in the materials used to make the products.

The following items are excluded from the warranty:

  • products without a purchase tax document (receipt or invoice);
  • products not purchased from an authorized retailer or through SASP INNOVATION srl
  • products whose identification codes have been removed, altered, deleted or made illegible (engines)
  • normal wear (including fatigue) such as, but not limited to, spokes breakage, wheels misalignment, brake wires breakage, tyres puncture
  • damage caused by abuse or improper use, incorrect assembly, incorrect or insufficient maintenance, accidents, blows, corrosion, the use of aggressive cleaners, use with incompatible products, repairs not carried out correctly, and more generally, everything that does not constitute a material or manufacturing defect
  • the products reached the natural end of the useful life cycle as tires, saddles, grips, batteries, etc.
  • the effects of exposure to UV rays (discoloration, yellowing, crystallization)
  • the effects of the saline environment
  • prolonged exposure to weather and rain
  • repainted products (even partially)
  • products used commercially, for professional competitions, in playful evolutions or in uneven, unpaved or typically MTB trails
  • products that have undergone any modification
  • improper use, if the product is e.g. exposed to extreme temperatures, moisture or humidity or if it was damaged due to the failure to comply with the safety instructions for the handling and storage written in the user manual
  • shipping damage (responsible for the carrier)
  • aesthetic defects that were easily detected when the product was purchased.

The return of the products does not extend or suspend the end of the warranty period.

This warranty applies only to the original purchaser and is not transferable. This warranty is expressly limited to the repair or replacement of a defective product.

Frames, components and accessories that are found to be defective by SASP Innovation in terms of this warranty will be repaired or replaced, at the discretion of SASP Innovation, free of charge. In case of unavailability of the original product, the replacement will take place with a similar product of equivalent value.

To receive warranty assistance, address your request to info@trisbike.com, or to the authorized retailer where you made the purchase, trying to describe as much as possible the problem encountered, also using the support of photographs, in order to speed up and help SASP Innovation staff understand the extent of the defect and identify the most appropriate solution.

In the event that components or products with defects need to be replaced, these must be sent to SASP Innovation complete with the original packaging, any user manuals and any accessories inside the original packaging. The shipping costs, both of the components to be replaced or of the products with defect as well as the replaced and repaired components and products, are entirely charged by the customer. All shipping costs are charged to the customer.

This warranty is the only one to have value between the parties and replaces and excludes any obligation and liability of SASP Innovation for direct and/or indirect damages. We remind you that any return of goods, for the right of withdrawal or for problems with product conformity, must be previously authorized by SASP Innovation.

 1.4 DISCLAIMER

Although we undertake to operate as precisely as possible, we may, however, inadvertently incur inaccuracies or technical or factual inaccuracies and / or typographical errors. SASP Innovation does not guarantee that the information contained on its website, in the brochures and in data sheets are in accordance with the jurisdiction of each country or that the products displayed on the site are permitted for sale in all jurisdictions. Road use of bicycles is subject to local regulations, codes and laws: TRIS bicycles of SASP Innovation may require further adjustments to the original configuration to adapt it to them (for example, brakes; lights; acoustic signalling mechanisms). SASP Innovation does not assume any responsibility in the event that the equipment of brakes, lights, acoustic signalling mechanisms or other do not correspond to the local regulations in force.

SASP Innovation declines any and all liability for damage to third parties, people, animals, things, deriving from improper, irresponsible, reckless, negligent use of the bicycle. Theft, loss, damage or accidental breakage of the bicycle do not give the right to any replacement.

 1.5 RIGHT OF MODIFICATION

SASP Innovation reserves the right to cancel or modify this policy at any time without notice.

 2. RETURNS AND CHANGES

In compliance with the European Union legislation on distance contracts, you have the right to cancel the order, return a product or change it, communicating your decision within 14 days from the date on which you, or a person you indicated, physically took possession of the product and products.

In the specific case of the purchase of a bicycle, the return policy will be applicable only to standard configurations, the configured bikes or those whose frame has been built according to the customer’s biometric measurements, in compliance with art. 59 letter c) of the Consumer Code (“Exceptions to the right of withdrawal”) in derogation of articles 52 to 58 of the same Code.

An exception will be made if the delivered product does not comply with the order, presents defects or configuration errors attributable to SASP Innovation.

After having informed us of your intention to return the product, you have 14 days to return it, complete with receipt/invoice, original packaging and accessories supplied and/or free. If the product is damaged, the refund amount may be offset based on the loss of value of the product. Only unused products will be accepted. SASP Innovation reserves the right to refuse to make the refund if the product shows obvious signs of use or damage. Products that have been modified or altered will not be accepted.

SASP Innovation undertakes to refund the amount paid for the purchase, with the exception of shipping costs incurred at the time of purchase, which remain the responsibility of the Customer. Also the shipping costs for the return/change are charged to the customer.

To send the change/return request, send an email to info@trisbike.com indicating the following information:8

– Copy of the invoice

– Customer name and surname

– Complete address to pick up the products

– Telephone number of a contact

– Bank account on which you want to receive the amount of the return, in the case of return

– Preferred time to be contacted by the courier

– Indication of the product (s) to be changed or returned

– Indication of the reasons for the change or return request

Once your request has been analysed, SASP Innovation will send you an email within 72 hours with the shipment details and the related bill to be applied to the package to be returned.

In case of return, if the returned product or products prove to be suitable to the above mentioned conditions, you will receive a refund, within 15 working days from the arrival of the returned product, based on the original payment method.

In case of change, you will receive a new order confirmation with the specifications of the new shipment of the new package destined to you. The shipping costs for the new order are charged to the customer and this shipment will be made only upon receipt of the payment of the shipping costs.
